In accordance with the requisites of article 10 of the cited Law, the following information is given:

Access and/or use of this portal attributes the condition upon the USER, who accepts it, for said access and/or use, the General Conditions of Use stated her. The cited Conditions will be applied independently from the General Conditions for Contracting which, if applicable, must be observed.

 

PORTAL USE

The webpage provides access to a multitude of information, services, programmes and data (hereafter “the content”) on the internet belonging to INTERCESPED, SL or to its licensees which the USER may have access to. The USER assumes the responsibility of using the portal. Said responsibility is extended to the registration which was necessary to access certain services or content.

In said registration, the USER will be responsible for providing true and legal information. As a result of this registration, the USER may be provided with a password which they will be responsible for, committing to use it diligently and confidentiality. The USER commits to appropriately using the content and services which INTERCESPED, SL offers through their portal and in an expository manner but not limited to, not using them for:

  • carrying out illicit, illegal activities or those which are contrary to good faith and public order
  • to disseminate content or propaganda which is racist, xenophobic, illegally pornographic, in defence of terrorism or threatening towards human rights
  • to cause damage to the physical and digital systems of INTERCESPED, SL, its suppliers or third parties, to introduce or spread digital viruses in the network or any other physical or digital systems which may be susceptible to causing the aforementioned damage;
  • to try to access and, if necessary, use the email accounts of other users and change or alter their messages. INTERCESPED, SL reserves the right to remove any comments and contributions which violate the respect of a person’s dignity, whether these are discriminatory, xenophobic, racist, pornographic, threatening towards young people or children, public order or public security or which, in their opinion, are not deemed appropriate for publication. In any case, INTERCESPED, SL will not be held responsible for the opinions given by users in forums, chat rooms or other participatory tools.

 

INTELLECTUAL AND COMPANY PROPERTY

INTERCESPED, SL will be the title holder for all intellectual and company property rights on their website, as well as the elements contained in this (for advertising purposes, images, sound, audio, video, software or text; brands or logos, colour combinations, structure and design, selection of materials used, computer programmes necessary for their functioning, access and use, etc.).

In virtue of what is stipulated in articles 8 and 32.1, second paragraph, of the Intellectual Property Law, it is expressly prohibited to reproduce, disseminate and communicate publicly, including making available, fully or partly, the content on this webpage, for commercial purposes, in any form and through any technical means, without the authorisation of INTERCESPED, SL. THE USER commits to respecting the Intellectual and Company Property Rights of INTERCESPED, SL. They may view the portal elements and even print them, copy them and store them on a hard disc on their computer or any other physical support as long as they are, solely and exclusively, for their personal and private use. The USER must abstain from suppressing, altering, evading or manipulating any protective device or security system which has been installed on the INTERCESPED, SL pages.

EXCLUSION OF GUARANTEES AND LIABILITY

INTERCESPED, SL is not liable, in any case, for damage and harm of any kind which may occur, in an expository manner: mistakes or omissions in the content, lack of portal availability or transmission of a virus or malicious or harmful programmes in the content, in spite of having adopted all technological means necessary to avoid this.

MODIFICATIONS

INTERCESPED, SL reserves the right, without prior notice, to carry out modifications which they deem necessary to their portal, being able to change, suppress or add any content and services which they are providing through this in the manner in which these are presented or located in their portal.

In the case that the webpage has links or hyperlinks to other internet websites, INTERCESPED, SL will not exercise any control over said sites and content. In no case will INTERCESPED, SL assume any responsibility for the content which belongs to a third party website, or guarantee the technical availability, quality, reliability, accuracy, range, veracity, validity and constitutionality of any material or information contained in any of said hyperlinks or other internet websites.

Equally, inclusion of these external links does not imply any type of association, merging or participation with the connected organisations.

RIGHT TO EXCLUSION

INTERCESPED, SL reserves the right to deny or remove access to the portal and/or the services offered without the need for prior warning, at their own request or at the request of a third party, for those users who breach these General Conditions of Use.

GENERAL

INTERCESPED, SL will pursue the breach of these conditions, as well as any wrongful use of their portal, exercising all civil and penal actions which legally correspond.

MODIFICATION OF THESE CONDITIONS AND DURATION

INTERCESPED, SL may at any time modify the conditions determined here, being duly published as they appear here.

The validity of said conditions will be according to their exhibition and will be valid until they are duly published, whether or not they are modified by others.

APPLICABLE LEGISLATION AND JURISDICTION

The relationship between INTERCESPED, SL and the USER will be regulated by current Spanish law and any disputes will be submitted to the Judges and courts of the previously indicated city.
